1. About these Terms
These Terms of Use govern your access to and use of the VOXXBODY iOS application (the "App") offered by Charles Simmons Music & Fitness ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. Please read them carefully.
If you are a consumer resident in the European Union, your statutory rights under EU and applicable national law apply alongside these Terms and are not affected by them.
2. What VOXXBODY offers
VOXXBODY is a vocal training program combining structured movement with vocal exercises. The App provides the following:
Free content — available to all registered users at no cost:
- Getting Started: five short introductory videos covering VOXXBODY fundamentals
- Warmup Workout: an 8-minute full-body vocal warmup
- Vocal Range Tracker: 14-day free access from the date of account creation
VOXXBODY Starter — one-time purchase: A 90-day structured vocal training program comprising three progressive phases: Foundation (30 days), Rehearsal (30 days), and Showtime (30 days). Includes full Vocal Range Tracker access for the lifetime of the purchase.
Genre Bundles — auto-renewable subscriptions: Workout collections by performance style: World, Urban, Pop/Rock, and EDM. Each bundle is an independent subscription. New workouts are added to active bundles periodically. Includes full Vocal Range Tracker access for the duration of the subscription.
Vocal Range Tracker — included with any paid plan: A pitch-detection tool that measures your vocal range, identifies your voice type, and charts your progress over time. Free access is available for 14 days from account creation; after that, active tracker access requires a current paid plan.
3. Your account
You must create an account to access the App. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you become aware of any unauthorised use of your account, notify us immediately at support@voxxbody.com.
You must be at least 16 years of age to create an account without parental consent. By creating an account, you confirm that you meet this requirement or that a parent or guardian has consented on your behalf.
4. Purchases and payments
All in-app purchases are processed by Apple through the App Store. By completing a purchase, you also agree to Apple's Terms and Conditions, available at https://www.apple.com/legal/internet-services/itunes.
One-time purchases (VOXXBODY Starter): Payment is charged to your Apple ID at the time of purchase. Access is granted immediately and does not expire.
Subscriptions (Genre Bundles): Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. Renewal is charged to your Apple ID within 24 hours of the end of the current period. You can manage and cancel subscriptions at any time through your Apple ID account settings.
Pricing: Prices are displayed in the App at the time of purchase and may vary by region. We reserve the right to change subscription prices. Where required by law, we will notify you in advance of any price change affecting your active subscription.
We do not handle payment directly and do not store your payment information.
5. Right of withdrawal
If you are a consumer resident in the European Union, you generally have the right to withdraw from a digital content purchase within 14 days without giving a reason, under the EU Consumer Rights Directive.
However, you lose this right of withdrawal once the digital content has begun to be delivered with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal. When you complete an in-app purchase through the App Store, Apple presents this acknowledgement as part of the purchase flow and manages the withdrawal and refund process on our behalf.
For refund requests related to App Store purchases, please contact Apple directly via https://reportaproblem.apple.com. Apple's refund policies apply.
6. Content and intellectual property
All content within the App — including videos, audio, graphics, written materials, programme structures, and the VOXXBODY® trademark — is owned by or licensed to Charles Simmons Music & Fitness and is protected by copyright and other intellectual property laws.
Your purchase or subscription grants you a personal, non-transferable, non-exclusive licence to access and use the content for your own private, non-commercial purposes. This licence does not permit you to:
- Record, copy, download, or reproduce any video or audio content
- Share, redistribute, or make content available to others
- Use any content for commercial purposes
- Reverse-engineer or tamper with any part of the App
VOXXBODY® is a registered trademark of Charles Simmons Music & Fitness. Nothing in these Terms grants you any rights to use our trademarks or branding.
7. Acceptable use
You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You must not:
- Use the App in any way that could damage, overload, or impair its functioning
- Attempt to gain unauthorised access to any part of the App or its underlying systems
- Use automated tools to access or extract content from the App
- Misrepresent your identity or impersonate any other person
8. Content availability and changes
We aim to make all purchased and subscribed content continuously available. However, we cannot guarantee uninterrupted availability due to maintenance, technical issues, or circumstances outside our control.
For one-time purchases (VOXXBODY Starter): the workout content included at the time of purchase will remain available for the lifetime of your account.
For subscriptions (Genre Bundles): content within a bundle may change over time. We may add new workouts to an active bundle. In the event that we significantly reduce the content of a bundle in a way that materially affects its value, we will notify you in advance and provide you the opportunity to cancel without penalty before the change takes effect, in accordance with EU digital content law.
9. Limitation of liability
To the extent permitted by applicable law, our liability for damages arising from the use of the App is limited to cases of intent and gross negligence. This limitation does not apply to damages resulting from injury to life, body, or health, or to liability under mandatory applicable law.
We are not liable for any loss of data, loss of profits, or indirect or consequential damages arising from your use of the App, except where caused by our intentional or grossly negligent conduct.
Nothing in these Terms excludes or limits any rights you have as a consumer under applicable EU or national law that cannot be waived by contract.
10. Your statutory rights
If you are a consumer resident in the European Union, you have statutory rights under EU law and the law of your country of residence that apply regardless of these Terms. These include rights under the EU Digital Content Directive (2019/770), which provides remedies if the digital content we provide does not conform to the contract. These Terms do not affect those rights.
11. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice before they take effect. If you do not accept the revised Terms, you may close your account. Continued use of the App after the effective date of any change constitutes acceptance of the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the law of your country of residence that cannot be excluded by contract.
Disputes arising from these Terms may be submitted to the courts of your country of residence (for EU consumers) or to the courts of Stuttgart, Germany.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr, which you may use to resolve disputes with us out of court. We are not obliged to participate in alternative dispute resolution proceedings but are willing to do so where required by law.

1. Geltungsbereich
Diese Nutzungsbedingungen regeln den Zugang zur und die Nutzung der iOS-App VOXXBODY (im Folgenden „App"), die von Charles Simmons Music & Fitness (im Folgenden „wir" oder „uns") angeboten wird. Mit der Erstellung eines Kontos oder der Nutzung der App erklären Sie sich mit diesen Nutzungsbedingungen einverstanden. Bitte lesen Sie diese sorgfältig durch.
Wenn Sie Verbraucherin oder Verbraucher mit Wohnsitz in der Europäischen Union sind, gelten Ihre gesetzlichen Rechte nach EU-Recht und dem anwendbaren nationalen Recht neben diesen Nutzungsbedingungen und bleiben von diesen unberührt.
2. Leistungsumfang
VOXXBODY ist ein Stimmtraining-Programm, das strukturierte Bewegungsübungen mit Stimmübungen verbindet. Die App umfasst folgende Angebote:
Kostenlose Inhalte – für alle registrierten Nutzerinnen und Nutzer ohne Zusatzkosten zugänglich:
- Getting Started: fünf kurze Einführungsvideos zu den Grundlagen von VOXXBODY
- Warmup Workout: ein 8-minütiges Ganzkörper-Stimmaufwärmprogramm
- Vocal Range Tracker: kostenloser Zugang für 14 Tage ab Kontoerstellung
VOXXBODY Starter – Einmalkauf: Ein strukturiertes 90-Tage-Stimmtraining-Programm in drei aufeinander aufbauenden Phasen: Foundation (30 Tage), Rehearsal (30 Tage) und Showtime (30 Tage). Enthält dauerhaften Zugang zum Vocal Range Tracker für die Laufzeit des Kaufs.
Genre-Bundles – automatisch verlängerbare Abonnements: Trainingssammlungen nach Performance-Stil: World, Urban, Pop/Rock und EDM. Jedes Bundle ist ein eigenständiges Abonnement. In aktive Bundles werden regelmäßig neue Trainingseinheiten aufgenommen. Enthält vollen Zugang zum Vocal Range Tracker für die Dauer des Abonnements.
Vocal Range Tracker – im Lieferumfang jedes kostenpflichtigen Tarifs enthalten: Ein Stimmerkennungs-Tool, das Ihre Stimmreichweite misst, Ihren Stimmtyp bestimmt und Ihren Fortschritt im Zeitverlauf aufzeichnet. Der kostenlose Zugang gilt für 14 Tage ab Kontoerstellung; danach ist ein aktiver kostenpflichtiger Tarif erforderlich.
3. Ihr Konto
Zur Nutzung der App ist die Erstellung eines Kontos erforderlich. Sie sind verantwortlich für die Sicherheit Ihrer Zugangsdaten sowie für alle Aktivitäten, die unter Ihrem Konto stattfinden. Bei Verdacht auf eine unbefugte Nutzung Ihres Kontos benachrichtigen Sie uns bitte unverzüglich unter support@voxxbody.com.
Zur Kontoerstellung müssen Sie mindestens 16 Jahre alt sein oder über die Einwilligung einer erziehungsberechtigten Person verfügen. Mit der Erstellung eines Kontos bestätigen Sie, dass Sie diese Voraussetzung erfüllen.
4. Käufe und Zahlungen
Alle In-App-Käufe werden von Apple über den App Store abgewickelt. Mit dem Abschluss eines Kaufs erklären Sie sich zusätzlich mit den Allgemeinen Geschäftsbedingungen von Apple einverstanden, abrufbar unter https://www.apple.com/legal/internet-services/itunes.
Einmalkäufe (VOXXBODY Starter): Der Kaufbetrag wird zum Zeitpunkt des Kaufs Ihrer Apple-ID in Rechnung gestellt. Der Zugang wird sofort gewährt und läuft nicht ab.
Abonnements (Genre-Bundles): Abonnements verlängern sich automatisch am Ende des jeweiligen Abrechnungszeitraums, sofern sie nicht mindestens 24 Stunden vor dem Verlängerungsdatum gekündigt werden. Die Verlängerungsgebühr wird innerhalb von 24 Stunden vor Ablauf des laufenden Zeitraums Ihrer Apple-ID belastet. Abonnements können jederzeit über die Einstellungen Ihrer Apple-ID verwaltet und gekündigt werden.
Preise: Die jeweils gültigen Preise werden Ihnen in der App vor dem Kauf angezeigt und können je nach Region variieren. Wir behalten uns vor, Abonnementpreise anzupassen. Soweit gesetzlich vorgeschrieben, werden wir Sie über Preisänderungen, die Ihr laufendes Abonnement betreffen, rechtzeitig im Voraus informieren.
Zahlungen werden nicht direkt von uns verarbeitet; Zahlungsdaten werden von uns nicht gespeichert.
5. Widerrufsrecht
Wenn Sie Verbraucherin oder Verbraucher mit Wohnsitz in der Europäischen Union sind, steht Ihnen grundsätzlich ein gesetzliches Widerrufsrecht zu. Danach können Sie einen Vertrag über digitale Inhalte innerhalb von 14 Tagen ohne Angabe von Gründen widerrufen.
Das Widerrufsrecht erlischt jedoch, wenn die Lieferung der digitalen Inhalte mit Ihrer ausdrücklichen Zustimmung vor Ablauf der Widerrufsfrist begonnen hat und Sie zur Kenntnis genommen haben, dass Sie dadurch Ihr Widerrufsrecht verlieren. Bei In-App-Käufen über den App Store holt Apple diese Bestätigung als Teil des Kaufvorgangs ein und wickelt Widerruf und Erstattung in unserem Auftrag ab.
Erstattungsanfragen im Zusammenhang mit App-Store-Käufen richten Sie bitte direkt an Apple unter https://reportaproblem.apple.com. Es gelten die Erstattungsrichtlinien von Apple.
6. Inhalte und geistiges Eigentum
Sämtliche Inhalte der App – darunter Videos, Audiomaterial, Grafiken, Texte, Programmstrukturen und die Marke VOXXBODY® – sind Eigentum von Charles Simmons Music & Fitness oder werden von uns lizenziert und sind urheberrechtlich sowie durch weitere Schutzrechte geschützt.
Mit dem Kauf oder Abonnement erhalten Sie eine persönliche, nicht übertragbare und nicht ausschließliche Lizenz zur Nutzung der Inhalte für Ihre eigenen privaten, nicht kommerziellen Zwecke. Diese Lizenz berechtigt Sie insbesondere nicht dazu:
- Videoinhalte oder Audioinhalte aufzuzeichnen, zu kopieren, herunterzuladen oder zu vervielfältigen
- Inhalte zu teilen, weiterzuverbreiten oder Dritten zugänglich zu machen
- Inhalte für kommerzielle Zwecke zu nutzen
- die App oder ihre Bestandteile zu dekompilieren oder zu manipulieren
VOXXBODY® ist eine eingetragene Marke von Charles Simmons Music & Fitness. Aus diesen Nutzungsbedingungen ergeben sich keine Rechte zur Nutzung unserer Marken oder unseres Erscheinungsbildes.
7. Zulässige Nutzung
Sie verpflichten sich, die App ausschließlich zu rechtmäßigen Zwecken und im Einklang mit diesen Nutzungsbedingungen zu nutzen. Es ist Ihnen insbesondere untersagt:
- die App auf eine Weise zu nutzen, die deren Funktionsfähigkeit beeinträchtigen oder beschädigen könnte
- sich unbefugten Zugang zu Teilen der App oder ihrer technischen Infrastruktur zu verschaffen
- automatisierte Tools zum Zugriff auf oder zur Extraktion von Inhalten aus der App zu verwenden
- Ihre Identität zu verschleiern oder eine andere Person zu imitieren
8. Inhaltsverfügbarkeit und Änderungen
Wir sind bestrebt, alle erworbenen und abonnierten Inhalte dauerhaft verfügbar zu halten. Wir können jedoch keine ununterbrochene Verfügbarkeit garantieren, da etwa Wartungsarbeiten, technische Störungen oder Umstände außerhalb unserer Kontrolle auftreten können.
Einmalkäufe (VOXXBODY Starter): Die zum Kaufzeitpunkt enthaltenen Trainingsinhalte bleiben für die gesamte Laufzeit Ihres Kontos zugänglich.
Abonnements (Genre-Bundles): Die Inhalte eines Bundles können sich im Laufe der Zeit ändern. Aktive Bundles werden regelmäßig um neue Trainingseinheiten ergänzt. Sollten wir den Umfang eines Bundles in einer Weise wesentlich reduzieren, die seinen Wert erheblich beeinträchtigt, werden wir Sie rechtzeitig im Voraus informieren und Ihnen die Möglichkeit geben, das Abonnement ohne Nachteile zu kündigen, bevor die Änderung in Kraft tritt. Dies gilt entsprechend den Vorgaben des EU-Rechts über digitale Inhalte.
9. Haftungsbeschränkung
Soweit gesetzlich zulässig, beschränkt sich unsere Haftung für Schäden aus der Nutzung der App auf Fälle von Vorsatz und grober Fahrlässigkeit. Diese Beschränkung gilt nicht für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie für Ansprüche, die auf zwingend anwendbarem Recht beruhen.
Für den Verlust von Daten, entgangenen Gewinn oder mittelbare Schäden, die aus der Nutzung der App entstehen, haften wir nur im Falle von Vorsatz oder grober Fahrlässigkeit.
Zwingende Verbraucherrechte nach EU-Recht oder dem anwendbaren nationalen Recht, die vertraglich nicht abbedungen werden können, bleiben von diesen Regelungen unberührt.
10. Gesetzliche Verbraucherrechte
Wenn Sie Verbraucherin oder Verbraucher mit Wohnsitz in der Europäischen Union sind, stehen Ihnen unabhängig von diesen Nutzungsbedingungen gesetzliche Rechte nach EU-Recht und dem Recht Ihres Wohnsitzlandes zu. Dazu zählen insbesondere die Rechte aus der EU-Richtlinie über digitale Inhalte und digitale Dienstleistungen (Richtlinie 2019/770/EU), die Abhilfemöglichkeiten vorsieht, wenn die bereitgestellten digitalen Inhalte nicht vertragsgemäß sind. Diese Nutzungsbedingungen berühren diese Rechte nicht.
11. Änderungen dieser Nutzungsbedingungen
Wir behalten uns vor, diese Nutzungsbedingungen zu aktualisieren. Über wesentliche Änderungen informieren wir Sie vor deren Inkrafttreten per E-Mail oder durch einen Hinweis in der App. Wenn Sie den geänderten Nutzungsbedingungen nicht zustimmen, können Sie Ihr Konto schließen.
